2. General terms
2.1. These terms govern the rights and obligations arising between the Seller and customer when purchasing goods from the Online Store.
2.2. By placing an order, the customer confirms that they have read and accept these terms of sale.
2.3. The Online Store may amend or supplement these terms. Changes are published on ero24.ee and apply to orders placed after they take effect.
2.4. If a provision conflicts with a legal rule that mandatorily applies to the consumer, that legal rule applies.
3. Products and product information
3.1. The Online Store sells adult intimate products, wellness products, lingerie, cosmetics and other products described in the store.
3.2. The Online Store provides the most accurate possible description, price, essential characteristics and other information necessary for a purchasing decision.
3.3. Before use, the customer must read the accompanying instructions, warnings, labels and user manual and use the product only as intended.
3.4. CE marking is used on products for which applicable EU legislation requires it. The absence of CE marking on a product not subject to that requirement does not in itself mean non-compliance with applicable requirements.
3.5. Product images are illustrative. Packaging design, colour shade and other non-essential details may vary slightly by manufacturer or batch without changing the product's essential characteristics.
4. Prices
4.1. All prices are in euros and include VAT unless stated otherwise.
4.2. Delivery costs are displayed during checkout before final confirmation.
4.3. The Online Store may change prices. The price displayed when the order was placed applies to that order.
4.4. If a price is clearly incorrect due to a technical or other obvious error and the customer should reasonably have recognised the error, the Online Store may cancel the order. Any amount already paid will be refunded.
5. Placing an order
5.1. The customer selects products, adds them to the basket, chooses delivery and payment methods and enters the information necessary to fulfil the order.
5.2. The customer is responsible for the accuracy of the information provided.
5.3. Before final confirmation, the order contents, product prices, delivery cost and total amount are displayed.
5.4. By submitting the order, the customer confirms the information is correct and that they are entitled to enter into the contract.
6. Formation of the contract and payment
6.1. Orders can be paid using the methods offered at checkout.
6.2. The contract takes effect after the order is confirmed and the amount due reaches the Seller or the payment provider confirms successful payment.
6.3. After the order is placed, confirmation is sent to the email address provided by the customer.
6.4. The Online Store may cancel an unpaid order.
6.5. If an ordered product cannot be supplied, the Online Store informs the customer as soon as possible and refunds the amount paid for the undelivered product.
7. Delivery
7.1. Goods are delivered to the countries and regions available for selection at checkout.
7.2. Available delivery methods, prices and estimated delivery times are displayed during checkout.
7.3. After preparing the order, the Online Store hands the parcel to the logistics partner selected by the customer.
7.4. The customer is responsible for the accuracy of the name, telephone number, email, parcel locker or delivery address provided.
7.5. If delivery fails because of incorrect or incomplete information, or the customer does not collect the parcel within the specified time, the customer may be responsible for reasonable additional redelivery or return costs.
7.6. The Online Store remains responsible to consumer customers for proper fulfilment even when a third-party logistics partner is used, except as provided by law.
8. Discreet packaging
8.1. Given the nature of its products, the Online Store packs orders as discreetly and neutrally as possible.
8.2. Outer packaging does not show product names, categories, images or other information from which the contents could reasonably be inferred.
8.3. Only information needed for delivery and compliance with legal requirements is shown.
8.4. The Online Store does not place advertising referring to sexual or intimate products on outer packaging.
9. The 14-day right of withdrawal
9.1. Consumer customers generally have the right to withdraw from a contract made in the Online Store without giving a reason within 14 days of the day the customer or their nominated third party receives the goods.
9.2. To exercise this right, the customer must submit an unequivocal withdrawal statement within 14 days.
9.3. The statement can be submitted using the store's “Withdraw from contract” function or by emailing info@ero24.ee.
9.4. When the online withdrawal function is used, the Online Store immediately sends electronic acknowledgement of receipt.
9.5. The customer must send the goods back no later than 14 days after submitting the withdrawal statement.
10. Returns of health, hygiene and intimate products
10.1. Under § 53(4)(4¹) of the Estonian Law of Obligations Act and Article 16(e) of Directive 2011/83/EU, the 14-day right of withdrawal does not apply to sealed goods unsuitable for return for health protection or hygiene reasons if unsealed after delivery.
10.2. Depending on the particular product and packaging, this exception may apply to sexual aids, intimate-use products, lingerie, cosmetics, lubricants, gels, creams, massage oils and other health or hygiene products.
10.3. If a hygiene seal, protective film, sealed protective packaging or other protection ensuring hygienic integrity is opened, removed or damaged after receipt, and the product cannot be returned for health or hygiene reasons, the Online Store is not obliged to accept it under the 14-day right of withdrawal.
10.4. Being an intimate product does not in itself exclude withdrawal. A statutory health protection or hygiene reason must apply.
10.5. If the hygiene seal or sealed protective packaging is intact and unopened and no other statutory exclusion applies, the customer retains the statutory right of withdrawal.
10.6. This restriction does not limit the right to complain about a defective, damaged, incorrect or otherwise non-conforming product.
11. Condition of returned goods
11.1. Where withdrawal is available, the customer may handle the product only as necessary to establish its nature, characteristics and functioning.
11.2. The customer is liable, to the extent provided by law, for diminished value caused by handling beyond what is necessary for that examination.
11.3. Where possible, return the product with its original packaging, accessories, manuals and all other supplied items.
11.4. Missing or damaged original packaging does not itself exclude withdrawal, but the customer may be liable for the resulting diminished value.
12. Return costs
12.1. When exercising the 14-day right of withdrawal, the customer pays the direct cost of returning the goods.
12.2. The Online Store does not reimburse ordinary withdrawal return costs unless expressly stated otherwise for the particular order or promotion.
12.3. If goods are incorrect, defective, damaged or otherwise non-conforming, the Online Store bears reasonable return costs to the extent required by law.
13. Refunds
13.1. Following a valid withdrawal, the Online Store refunds payments received, including standard delivery costs to the extent required by law, within 14 days of receiving the withdrawal statement.
13.2. If the customer selected delivery more expensive than the cheapest standard method offered, the Online Store need not refund the additional cost.
13.3. The Online Store may withhold reimbursement until it receives the goods or evidence that they were sent back, whichever occurs first.
13.4. Refunds are normally made using the original payment method unless the parties agree otherwise.
14. Defective, damaged or incorrect goods
14.1. The Online Store is liable for non-conformity of goods sold to consumers under the conditions and to the extent prescribed by law.
14.2. Consumers may submit a complaint about non-conformity within two years of delivery of the goods.
14.3. If a defect or other problem occurs, please contact info@ero24.ee as soon as possible and, where possible, provide:
- name and contact details;
- order number;
- product name;
- description of the problem;
- photographs or video illustrating the problem.
14.4. The Online Store responds to complaints submitted in writing or a reproducible written form within 15 days of receipt.
14.5. If a complaint cannot be resolved within 15 days, the Online Store explains the delay and sets a new reasonable deadline.
14.6. Unless the law provides otherwise, the Online Store is not liable for defects caused by incorrect or unintended use, failure to follow instructions, customer damage or normal wear.
15. Age restriction
15.1. The ero24.ee store and its adult products are intended for people aged at least 18.
15.2. By placing an order, the customer confirms they are at least 18 and entitled to enter into the contract.
15.3. Where there is reasonable doubt, the Online Store may verify compliance with the age restriction by lawful means.
15.4. The Online Store may cancel an order if the age requirement is not met.
16. Processing personal data
16.1. Personal data is processed to receive and fulfil orders, process payments, deliver goods, provide customer service, meet legal obligations and for other lawful purposes.
16.2. Necessary data may be shared with payment providers, logistics partners, IT and hosting providers and other providers needed to fulfil orders or lawfully operate the Online Store.
16.3. Detailed processing terms, legal bases, retention periods and customer rights are described in the ero24.ee Privacy Policy.
17. Liability and force majeure
17.1. The Online Store and customer are liable for damage caused to each other in the cases and to the extent set out in Estonian law.
17.2. The Online Store is not liable for a breach to the extent it was caused by force majeure.
17.3. These terms do not limit or exclude statutory consumer rights.
18. Resolving disputes
18.1. If you have a complaint about the Online Store, please first contact:
Email: info@ero24.ee
Telephone: +372 5580 077
18.2. The Online Store and customer seek to resolve disputes primarily through negotiation.
18.3. If no agreement is reached, consumer customers may contact the Consumer Disputes Committee operating at the Estonian Consumer Protection and Technical Regulatory Authority or a court.
18.4. For cross-border consumer disputes in the EU, consumers may seek assistance from the European Consumer Centres Network, ECC-Net.
19. Applicable law
19.1. These terms and contracts concluded through the Online Store are governed by the law of the Republic of Estonia.
19.2. Applying Estonian law does not deprive consumers of protection under mandatory consumer rules of their country of habitual residence where those rules apply.
20. Changes to the terms of sale
20.1. The Online Store may amend or supplement these terms when legislation, services, payment or delivery methods or other circumstances change.
20.2. The terms in force when an order was placed generally apply to that order.
20.3. The current terms are always published on ero24.ee.
